Accuracy of Information

An Arrest Is Not a Conviction

An arrest does not establish guilt. A prosecutor may decline a charge, a filed count may be reduced or dismissed, and a court may enter a result favorable to the accused. A booking entry does not disclose the eventual outcome. Later changes under Texas Code of Criminal Procedure Chapter 55A, Government Code Chapter 411 nondisclosure provisions, or a correction can also make an old copy misleading. Verify the current disposition with the court, the originating agency, or the Texas Department of Public Safety Crime Records Division before reaching a conclusion.

A record is a lead, not a verdict. Only its official custodian can confirm the current contents and whether Texas law still permits public release.

Confirm a court date, warrant, custody status, or registry entry with the custodian that maintains it, such as the Floyd County Sheriff's Office, the proper criminal court, the Texas Department of Public Safety Crime Records Division, or the Texas Public Sex Offender Registry. Government Code Chapter 552 governs public-information requests to Texas public bodies, while Government Code Chapter 411 controls criminal-history information and authorized dissemination.
